Miami Springs Council Reconsiders Re-occupancy Requirements

by Isaac Benmergui, Esq on October 28, 2011

The Miami Springs Council recently rescinded the requirement that added an additional step to home ownership before a buyer could purchase a home. Previously the home had to be inspected for code violations. This step was in addition to the re-occupancy certification.

In a move that probably saved their Council seats, Councilmembers struck down the previous requirement. Residents felt the additional inspection could hurt home sales in the area by placing an additional financial burden on the seller, and further, that it was a violation of the Fourth and Fifth Amendment rights.
