When Should I Hire a Lawyer for a Real Estate Transaction?

by Isaac Benmergui, Esq on December 14, 2011

Most real estate transactions go off without a hitch and lawyers are seldom used when buying a home, but even the federal agency HUD recommends getting a lawyer to look over contracts to make certain all the paperwork is in order.

There are some real estate transactions; however, that hiring a lawyer is not only recommended, it is likely to save you thousands if you do. The following transactions can be a little tricky if you navigate them without counsel:

  • Leases
  • Condo purchase
  • Commercial property purchase
  • Rental purchase
  • For sale by owner properties
  • Short sale or foreclosure
  • Sales without a buyer’s agent
  • Sales where the seller carries the loan

Hiring an experienced real estate attorney can save you time and money in both the short-  and long-run, especially when mountains of complicated paperwork that you may not completely understand is involved.
