HB 319 Could Stop HOA Foreclosures

Florida’s Safe Harbor amendment may soon carry add-on legislation if HB 319 and SB 680 are passed in the Florida legislature.

As it stands, the amendment would allow the costs of collecting from delinquent condo and homeowners taken away from banks and passed on to homeowners. Attorney’s fees are included in those costs. If attorneys know they may not be recovering their fee, they’ll be less likely to want to file foreclosures or continue pursuing current cases based on HOA fees.

HB 319 looks like it will pass the House, but the Senate has yet to agree to the amendment. At present the bill’s outcome will affect 4.5 million Florida residents.
